Terms of Service
These Terms of Service ("Terms") govern your access to and use of sakuretsushen.com (the "Site"), the SakuretsuShen brand, the Sekko clip-pipeline tooling, and any related applications, integrations, or services we provide (collectively, the "Services"). The Services are operated by SakuretsuShen, an independent gaming creator brand ("we", "us", "our"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
01 · Eligibility
You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with the involvement of a parent or legal guardian. The Services are not directed to children under 13, and we do not knowingly collect information from them. If you believe a child under 13 has provided information to us, contact us at ops@sakuretsushen.com and we will delete it.
02 · The Services
The Site is the public homepage and content portal for the SakuretsuShen creator brand. It includes editorial content, links to third-party platforms (TikTok, YouTube, Twitch, X, Instagram, Kick, Discord), an email signup for drop and content alerts, and curated affiliate product references. The Sekko application provides AI-assisted clip processing and uploading tools for our own publishing pipeline; access is granted on an invitation basis and may be governed by additional terms presented at sign-up.
03 · Acceptable use
You agree not to:
- Use the Services in violation of any applicable law, regulation, or third-party right.
- Reverse engineer, decompile, scrape, or attempt to extract source code or data, except as permitted by law.
- Interfere with the operation of the Services, probe for vulnerabilities, or bypass rate limits or access controls.
- Impersonate SakuretsuShen, our staff, or any other person or entity.
- Upload, transmit, or distribute malware, spam, harassment, hate speech, or sexually explicit content involving minors.
- Use the Services to develop a competing product by means of mirroring, framing, or systematic copying of our content.
04 · Intellectual property
All content on the Site — including the 炸裂神 mark, the SakuretsuShen name and logos, written copy, video and audio assets, photography, graphic design, and the arrangement of the foregoing — is owned by us or licensed to us and is protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to view the Services for personal, non-commercial use. No other rights are granted by implication, estoppel, or otherwise.
05 · Third-party platforms and integrations
The Services link to and may integrate with third-party platforms, including TikTok, YouTube, Twitch, X (Twitter), Instagram, Kick, Discord, Amazon, Formspree, Ko-fi, and Vercel. We are not responsible for the content, policies, or practices of those platforms. Your use of those platforms is governed by their own terms and privacy policies. Where we integrate with TikTok via the TikTok Developer Platform, your use of those features is additionally governed by the TikTok Terms of Service and the TikTok Developer Policy.
06 · Affiliate disclosure
Some product links on the Site are affiliate links, including links to Amazon.com. As an Amazon Associate we earn from qualifying purchases. The price you pay is not affected by the use of an affiliate link. We only feature gear we would carry ourselves; we do not accept payment to alter editorial recommendations.
07 · Email signup & communications
If you submit your email address through the dispatch form, you consent to receive transactional and editorial emails from us regarding new clips, drops, and brand updates. We use Formspree to process form submissions. You may unsubscribe at any time using the link in any email or by writing to ops@sakuretsushen.com.
08 · User submissions
If you send us feedback, ideas, or content (including via email, social DMs, or the dispatch form), you grant us a worldwide, royalty-free, perpetual license to use, reproduce, and display that content in connection with operating and promoting the Services. Do not send us anything you consider confidential or that you do not have rights to.
09 · Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation. We do not guarantee that the Services will be free of errors, viruses, or other harmful components. Any reliance on content from the Services is at your own risk.
Game and brand notices. Arc Raiders is a trademark of Embark Studios AB. League of Legends is a trademark of Riot Games, Inc. Fortnite is a trademark of Epic Games, Inc. Ghost of Tsushima is a trademark of Sony Interactive Entertainment LLC. All other trademarks belong to their respective owners. SakuretsuShen is an independent creator and is not affiliated with, endorsed by, or sponsored by any of these companies.
10 · Limitation of liability
To the maximum extent permitted by law, in no event will SakuretsuShen, its operators, contractors, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your use of the Services. Our aggregate liability for any direct damages arising from these Terms or the Services will not exceed one hundred U.S. dollars (US$100).
11 · Indemnification
You agree to indemnify, defend, and hold harmless SakuretsuShen and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your breach of these Terms, your use of the Services, or your violation of any law or third-party right.
12 · Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including for violation of these Terms. Upon termination, the rights granted to you will cease and the surviving sections of these Terms will continue in effect.
13 · Governing law & disputes
These Terms are governed by the laws of the United States and the state in which the operator resides, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in that state, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any non-waivable right you have under your local law.
14 · Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above will reflect the most recent revision. Material changes will be highlighted on the Site or notified via email where appropriate. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
